DESCRIPTION: These records are created by Public Safety officers when a traffic accident occurs. They are maintained in order to keep an account of accidents in Utah, which must be reported to the Drivers License Division. The definition of this category of accidents may be found in UCA 41-6-35 (1991). Information includes date, day of week, time of day (all times expressed in 24-hour clock format), and location of accident; case number; description of involved vehicles, showing year, make, model, body style, color, registered weight, cargo (if any), and vehicle identification number; vehicle disposition (e.g., company which towed the vehicle or notation that it was driven away); officer's evaluation of validity of insurance; name of insurance company; effective dates and number of insurance policy; damage to vehicle, showing areas damaged and officer's estimate of cost to repair; owner and driver name, address, and telephone number; driver's license number, class, restrictions, and state, source of driver's education, years of driving experience, age, sex, and injuries; a diagram and narrative description of the accident by the investigation officer; times the officer was notified of the accident, arrived at the scene, and completed his investigation; record of arrests, showing the name of person cited and the charge; officer's signature, badge number, patrol division, and department; supervisor's approval; and date of report.

FORMAT MANAGEMENT

Paper: Retain in Office for 1 year after uninsured accident are transferred to series 81215 or until microfilmed or scanned and then destroy.

Microfilm master: For records prior to and including 2002. Retain in State Records Center for 10 years and then destroy.

Microfilm duplicate: For records prior to and including 2002. Retain in Office for 10 years and then destroy.

Optical disks: For records beginning in 2002 and continuing to the present. Retain in Office for 10 years and then destroy.

Administrative Fiscal Legal

This disposition is based on the administrative needs expressed by the agency. Previous decision: RDR 78-35 indicated that the records should be retained for eight years. The agency still needs the information for two renewal periods; however, the renewal periods have now changed from four years to five.
