These checks must be kept for 9 years in case they are needed as evidence in prosecution for medicaid fraud. 31 USCS 3731 sets a 6 year statute of limitations for bringing action on false claims. Two court cases have stated that the statute of limitations for medicare overpayments did not begin until after the provider has been audited. According to the Denver Regional Office of Health Care Financing, the government has 3 years in which to audit these records. The bureau can use the film for administrative purposes, but it cannot be used in a court action as it is produced by bank processing.
